Our IR35 Review Service is available to all Brookson customers. The IR35 Review Service provides complete, all round support for your self management of the IR35 risk.

The IR35 Review Service forms part of our standard service to all customers at no extra cost and is carried out by our specialist legal team.

Your IR35 status is dependent on both the terms of your contract and your working practices.

Brookson offer all of our customers 3 types of IR35 review:

1 Pre Assignment Review
If you send your contract to us before your assignment starts, we will review it and ensure that it will support you working as an independent consultant under IR35 and provide you with helpful advice if your contract needs to be changed.

Where there are any changes required to your contract, it is often easier to implement them before you start working on the assignment. Our Pre Assignment Review is specifically designed to help you make any changes before your assignment starts to ensure that you are in the best possible position from the outset.

You may also use this review to discuss any queries you may have regarding your proposed working practices with our specialist IR35 Advisors to help you start an assignment on the right foot.

2 Full Assignment Review
If you send your contract and a copy of our Employment Status Assessment Form to us, we will carry out a full review on your assignment to ensure you are compliant with IR35.

Again, during this review, we will be able to discuss with you any areas of your contract which do not reflect your working practices or any working practices which are inconsistent with those expected from an independent consultant. You can also raise any IR35 queries you may have and get professional expert advice from a specialist IR35 advisor.

3 Refresher Employment Status Assessment (RESA)
If you have been on your assignment for over 6 months and have previously had a full assignment review, we can review your working practices to ensure you continue to work compliantly by sending us a copy of our Refresher Employment Status Assessment Form (RESA).

If you follow our advice and procedures, you will be guided through the process and remain compliant. As a director of your company however, an awareness of IR35 and the implications when negotiating contracts will also help to prevent any future complications.
